Kim Ogg, Harris County, TX District Attorney believes there is enough evidence to convict and is seeking the death penalty for two illegal migrants from Venezuela accused of killing 12-year-old Jocelyn Nungaray on June16th when she left her mother’s apartment to get a soda at a convenience store.
Typically, Texas’ capital murder laws involving a child between 10-15 years old don’t allow a death penalty sentence, but with the addition of sexual assault (and kidnapping) charges, the case is eligible for the death penalty.
Franklin Pena, 26 and Johan Martinez-Rangel, 22 are accused of kidnapping Nungaray, sexually assaulting her, and strangled her death after they lured her out of the store. The two then left her body with her pants off, tied up under a bridge.
Both suspects are being charged with capital murder. They are also possibly members of the Venezuelan gang, Tren de Aragua.
Ogg said, “We are seeking death because we want the message out there that, regardless of who you are, but especially if you are illegally in this country, that you will face the same consequences as anyone else for murdering a child during the course of raping and kidnapping her.”
