Supreme Court Rules in Favor of Fischer

The United States Supreme Court has handed January 6th defendants a win. 


On Friday,  the Supreme Court ruled 6-3 in favor of January 6th defendant Joel Fischer. 


Fischer, a former police officer was charged under an accounting law after he briefly entered the U.S. Capitol on January 6th, 2021.  He argued that he should not have been charged  under section 1512 (c), an evidence tampering provision of the Sarbanes Oxley Act. 


Prosecutors for the corrupt Biden regime laid charges under an evidence tampering provision of the Sarbanes Oxley Act, which its purpose was to curb wrongdoing on Wall Street. 


Following the breach, Fischer was indicted on several counts including obstructing an official proceeding under an Enron era obstruction law 18 U.S. Code Section 1512(c). The wording for 1512(c) is focused on documentation and ensuring it is made available for official proceedings. 


Section 1512(c) states: *Whoever corruptly (1) alters, destroys, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object's integrity or availability for use in an official proceeding; or (2) otherwise obstructs, influences, or impedes any official proceeding or attempts to do so, shall be fined under this title or imprisoned not more than 20 years or both." 


With this ruling, it is expected to make it more difficult for the federal government to prosecute those charged in connection with the Capitol breach while Congress was attempting to finalize the fraudulent 2020 presidential election results.
