Home Depot Ruling: They Broke the Labor Law

The National Labor Relations Board (NLRB) ruled yesterday that Home Depot broke the labor law when they fired an employee, Antonio Morales, who refused to remove a handwritten acronym “BLM” on his apron supporting Black Lives Matter.


The NLRB found that Home Depot violated Morales’ rights of the National Labor Relations Act (NLRA), by “directing Morales to remove the BLM marking, by applying its dress code and apron policy to prohibit Morales from wearing the BLM marking, and by constructively discharging Morales for declining to remove it.” The NLRB also said the writings were a “protected concerted activity to protest other racial injustice occurrences that took place at the store.”


The ruling found that Morales must be reinstated and reimbursed for any lost earnings.

A Home Depot spokesperson said, “We disagree with the NLRB’s decision. The Home Depot is fully committed to diversity and respect for all people. We don’t tolerate any kind of workplace harassment or discrimination.”
